TERMS & CONDITIONS
The following Agreement describes the terms and conditions that apply to your participation and membership in the LOYALE mobile loyalty app program (“LOYALE”). By participating in and registering for LOYALE, you agree to the terms of this agreement.
You must be at least 21 years of age to use LOYALE. LOYALE is for individual use only and individuals may have one, and only one account. Participants may not share the use of an account with any other users. LOYALE maintains the right to terminate any account or disqualify any user at any time for any reason deemed appropriate by LOYALE or its affiliates without notifying the user of the reason. Employees of establishments that are utilizing LOYALE are permitted to become members of the LOYALE program. Any account left idle without use for 5 months may be terminated by LOYALE without prior warning to the participant.
SETTING UP LOYALE:
To set up an account and become a LOYALE member, simply download the LOYALE Mobile App on your phone. You must verify that you are 21 years of age or older in order to use the app. Then, register your account with a name and a unique, valid e-mail address. At that point your membership is active and you may begin to track your purchases. Qualifying purchases can be tracked by scanning the appropriate code at the participating location(s). Each scan is tracked as a “punch” on your virtual punch card. You are responsible for updating your account information. Account information that is out of date may result in a loss of punches or cancellation of an account without prior warning. Punches and offers cannot be earned or redeemed unless you submit a unique, valid e-mail address.
Membership CANCELLATION OR TERMINATION OF BENEFITS:
To cancel a membership account at any time, simply contact LOYALE and notify us of your wish to end your membership. LOYALE may cancel this app in its entirety; end or modify any specific component of the app; modify user requirements for participation; and/or modify any other feature of the app at any time and without prior notice. Any changes to the app may expire your punches and those expired punches will have no cash value. Stored punches may be cancelled or modified at any time, even if this may prevent the ability to use previously accumulated punches.
LOYALE members can collect punches from any participating establishment’s qualifying products. A participating establishment will determine which of its products are considered qualifying products. LOYALE members simply notify an employee of his/her LOYALE membership and request to scan the product code to track purchases via punches. Participating establishments may choose to make product codes available on products that are distributed off its premises. Participating establishments are listed on LOYALE. Qualifying offers may be redeemed at participating establishments. As state and local laws may vary across participating establishments, the ways establishments set rates for accumulating punches and redeeming offers may vary by location. All punches and offers will be determined by the location of the participating establishment and in accordance with all federal, state, and local laws. LOYALE reserves the right to suspend or withdraw any participating establishments without prior notice, in accordance with any contracts signed between LOYALE and the participating establishment.
PUNCHES & OFFERS:
Discounts and offers may be offered on purchases where permitted by law. All punches and offers are tracked on your account. Codes may only be scanned and punches received by a consumer who orders and provides valid state identification for the purchase verifying their age as 21 or older. Codes may only be scanned and punches received by consumers who are 21 years of age or older.
LOYALE punch rates are determined by participating establishments. Hours and dates to accumulate punches are subject to the participating establishments conditions. Establishments may change punch rates depending on the hour, date, or product purchased. It is the LOYALE members’ obligation to remain informed about punch rates. Punches expire after 1 year (12 months) of account inactivity. ALL PUNCH VALUES ARE SUBJECT TO AND BASED ON THE LAWS IN YOUR STATE.
LOYALE offers are determined by participating establishments. Hours and dates to redeem offers are subject to the participating establishments conditions. Establishments may change offers depending on the hour, date, or product purchased. It is the LOYALE members’ obligation to remain informed about all qualifying offers. A participating establishment may cancel or change an offer without giving prior notice to LOYALE members. ALL OFFERS ARE SUBJECT TO AND BASED ON THE LAWS IN YOUR STATE.
Your offers and punches are determined by participating establishments and are subject to applicable federal, state and local laws. Offers and punches are subject to change without prior notice to LOYALE members. Redemptions of discounts and offers may vary depending on the location, particular offer, and availability. Punches are non-transferable, have no cash value, cannot be redeemed for cash, cannot be used for the purchase of gift certificates and merchandise, and may expire. Participating establishments may specify the maximum allowable punch accumulation and maximum offer redemptions per day, week, or year.
- We will only retain personal information as long as necessary for the fulfillment of LOYALE’s purposes.
- We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
- Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
- We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
- We will make readily available to customers information about our policies and practices relating to the management of personal information.
- We may collect personally identifiable information when you use the LOYALE app or receive such information from participating establishments.
- We may use this information for five (5) primary purposes: (1) to customize the content of the app based on your account information (2) to provide you with offers or information from participating establishments; (3) to connect you with participating establishments; (4) to better satisfy your request(s) for services and information; and, (5) to contact you about LOYALE and offers from participating establishments.
We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.
LEGAL LIABILITY LIMITS:
You agree that LOYALE and its parent company BOTTLE BRANDERS LLC, shall not be responsible or liable to you for any claim, loss, injury, damage, delay, accident, cost or expense, including attorney's fees, arising out of or related to the LOYLE app, these Terms & Conditions, and the mobile app, or the use of the information you provide to us to register for your LOYALE account.
ANY ATTEMPT TO INTENTIONALLY DAMAGE THE LOYALE APP MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, BOTTLE BRANDERS LLC RESERVES THE RIGHTS TO DISQUALIFY AND TO SEEK DAMAGES OR OTHER LEGAL REMEDIES FROM ANY PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
